Terms & Conditions

Atlanta Premier Tree Solutions, LLC hereby offers to perform the included scope of services for the customer on the Terms & Conditions included in Proposal of Services.

Cost includes removal of all tree debris from property pertaining to the scope of services described (with the exception of stump removal) unless otherwise noted in scope of work. Debris/chips from any requested stump grinding will be left on site. Debris/chips from stump grinding can be removed, but additional cost will apply.

Customer hereby accepts cost noted on Proposal for Services and Terms & Conditions and agrees to make payment for the Work upon completion of it pursuant to the Terms and Conditions.

SCOPE OF WORK: (1) Atlanta Premier Tree Solutions, LLC (“Atlanta Premier”) will provide services as identified and described in the scope of services("Work) on this proposal. (2) Any additional requested work beyond this noted scope of services will require a change order with new pricing agreed and signed by customer prior to starting additional work. (3) Any line item indicating tree removal will not include stump grinding or root chasing unless otherwise noted as a separate line item with associated costs. If these line items are noted, completion is done on a different day due to the specialized equipment needed, but completed within 3-5 days. If root chasing is requested, note that only exposed roots can be removed. If utility locates are required, Atlanta Premier will complete on customer's behalf. (4) In the event of storm damage to a property, if a tarp on the roof is necessary, Atlanta Premier shall place a tarp on the roof in an effort to slow entry of water into the property; however, Atlanta Premier does not guarantee or warrant that no water will enter the property. Therefore, Atlanta Premier will have no liability for water damage that may occur to the property. (5) Owner agrees to allow any and all Subcontractors hired by Atlanta Premier, including but not limited to stump grinding companies onto Owner's property to perform the Work pursuant to this proposal.

PRICING: (1) Price may be subject to change ONLY IF scope of property impacting requested tree work has been altered (e.g. adding pool/pond, landscape, hardscape, shed, etc.) subsequent to submitted proposal.

PAYMENT: (1) For out of state property owners only, a $100 deposit will be required and a valid credit card number will be kept on file until services are rendered. Upon rendered services, out of state property owner authorizes Atlanta Premier to execute credit card transaction for remaining balance. (2) Payment is due upon rendered services. Tree removal services (excluding stump grinding and/or log pick up) will be required to be paid in full upon completion of work. Stump grinding is completed on a separate day, therefore cost can be paid separately upon completion of work. (3) All balances not paid by due date are subject to finance charge of 1.5% monthly, 18% annually. In the event of non-payment by the customer, a "Mechanic's Lien" will be placed on the property for the amount of the unpaid balance plus any applicable interest and associated lien fees. Atlanta Premier will be entitled to interest and attorney's fees and costs incurred in any collections, litigation, mediation or arbitration necessitated by non-payment by the customer.

CUSTOMER'S RESPONSIBILITY: (1) It is the customer's responsibility to identify underground low voltage wiring and/or irrigation system - Atlanta Premier can not be responsible for damages done by stump grinder. (2) It is the customer's responsibility to research and obtain Homeowners' Association (HOA) approval if required by HOA covenants and bylaws. (3) It is the customer's responsibility to research and obtain tree removal permit and any associated fees should one be required by your city. Your local government website will provide you pertinent information on the permit application process. (4) It is the customer's responsibility to move any removable structures such as bird houses, garden decor, planters, fountains, solar-powered lights, statues, bird bath, etc. that may be in the surrounding area and/or pathway of the tree work to avoid potential damage. This should be moved prior to scheduling tree work. Original proposal amount may be subject to change if the crew will be required to move these structures upon arrival of work completion. Atlanta Premier will not be responsible for damage that occurs to these removable items that are left outside.

LIMITATION OF LIABILITY/WARRANTY: (1) Atlanta Premier will perform the Work in accordance with industry standards. Except as provided in these Terms and Conditions, Atlanta Premier disclaims any and all warranties pertaining to the Work whether oral or written, express or implied, or arising by operation of law including, without limitation any warranty of merchantability or fitness for a particular purpose. Customer agrees Atlanta Premier has made no representations, warranties, or guaranties that performance of the Work will achieve any particular or specified result or goal including, without limitation, achievement of a certain aesthetic effect or that a tree will not cause injury, harm or damage to person or property. Customer acknowledges tree removal work is inherently dangerous and assumes all risks associated with the Work, except any property damage or bodily injury that is directly caused by Atlanta Premier's intentional misconduct or gross negligence during course and scope of work while on site. Atlanta Premier will not be responsible for any existing or indirect property damage prior to commencement of work described herein. Customer understands that in order to perform the work, cranes, trucks, Bobcat and related heavy equipment ("Equipment") must cross over the driveway and/or lawn and landscaping ("Driveway/Lawn) on the property. Atlanta Premier does not know nor has any way of knowing the thickness, weight capacity or other characteristics of the Driveway/Lawn or of the soil below; cracking and other damage may well occur to the Driveway/Lawn (with the potential resulting damage to other improvements beneath the Driveway/Lawn) as a result of the movement of the Equipment over Driveway/Lawn; damage or destruction may well occur to shrubbery, trees, pools, or any other structure, thing or apparatus beneath or near the Equipment as a result of the weight of Equipment. Therefore, Atlanta Premier will be released from liability unless such cracking or damage to Driveway/Lawn or damage or destruction of sod, shrubbery, trees, pools or any other structure, thing or apparatus beneath or near equipment that results from the weight and movement of the Equipment results from Atlanta Premier's intentional misconduct or gross negligence of any of such persons or entities or from the sole negligence of any of such person or entities. To the fullest extent permitted by law, Customer, on Customer’s behalf and anyone claiming to have any legal right or claim by and/or through Customer, agrees to defend, indemnify and hold harmless Atlanta Premier and its members, manager, representatives, employees, and agents, from and against all claims, damages, losses, or expenses arising out of the Work except to the extent the claim, damage, or loss is attributable to Atlanta Premier’s gross negligence or is intentional misconduct. Customer, on Customer’s behalf and anyone claiming to have any legal right or claim by and/or through Customer, waives all rights of subrogation against Atlanta Premier and its members, manager, representatives, employees, and agents for any property damage or bodily injury to the extent covered by any insurance maintained or held by Customer or for Customer’s benefit. Customer agrees Jeff Roth is the sole person authorized on behalf of Atlanta Premier to amend or change these Terms and Conditions and that Atlanta Premier is not bound by any amendment or change made by another.

CANCELLATION OF WORK: (1) Either Atlanta Premier or the customer may cancel the performance of the work at any time before the work begins, except that any cancellation on the part of the customer must be submitted in writing to Atlanta Premier at least seventy-two (72) hours in advance of the scheduled performance of the Work. Should the customer cancel any work within twenty-four (24) hours or less of the scheduled commencement of the work, the customer shall pay a cancellation fee of two hundred dollars ($200.00) or five percent (5.00%) of the total Contract Sum, whichever is greater, on or before the scheduled date of the Work.

PROPOSAL EXPIRATION: (1) All proposals are valid for 90 days.
